Position Summary: Under the direction of the Executive Deputy Counsel for Employment and General Practice and the General Counsel of the Department of Education (DOE), the Deputy Counsel supervises the General Practice Unit (GPU), including the Charter School and 3-K/Pre-K sub-groups. The Deputy Counsel engages in difficult and complex legal work having significant financial, procedural, or policy consequences for the DOE, and provides legal advice and interpretation on various issues to administrators throughout the DOE. Performs related work.

Reports to: Executive Deputy Counsel for Employment and General Practice

Direct Reports: Agency Attorneys and support staff

Key Relationships: General Practice Unit attorneys, Charter School supervisor, Pre-K supervisor, Director, Senior Field Counsel, Central Offices.

Responsibilities

* Supervises GPU attorneys and support staff, including the Charter School and 3-K/Pre-K sub-groups.
* Supports high-level DOE administrative staff in the development of significant educational policy initiatives.
* Serves as counsel to DOE's managerial and executive staff on employment matters. Defends the agency in major class actions, complex and significant litigation in state and federal court, and governmental investigations such as US Department of Education, Office for Civil Rights, and Department of Justice/US Attorney.
* Advises DOE officials on constitutional issues and statutory interpretation.
* Recommends and approves settlements in litigation.
* Corresponds with elected and appointed officials, community organizations, and members of the public on behalf of the General Counsel.
* Drafts and analyzes legislation affecting the DOE.
* Manages projects such as the revision of Chancellor's Regulations.
* Prepares, organizes, and presents professional development for legal staff.
* Works with the City Law Department and high-level DOE staff on litigation strategy.
* Manages workload decisions for GPU attorneys. Meets regularly with attorneys to review the status of cases, productivity, and goals.
* Prepares and maintains delegations of authority from the Chancellor.

Qualification Requirements:

Minimum

* Admission to the New York State Bar; and four years of recent full-time responsible, relevant, satisfactory legal experience subsequent to admission to any bar, of which eighteen months must have been in the supervision of other attorneys, in an administrative, managerial or executive capacity, or performing highly complex and significant legal work.

Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.

Preferred

* Ability to manage large staff that handles diverse issues.
* Ability to rapidly understand law and regulations and determine applicability.
* Ability to write clearly and concisely.
* Ability to conduct legal research efficiently.
* Civil litigation experience.
* Internal candidates preferred.

Salary: $125,256+

(Internal candidates who are selected for this position and who currently hold comparable or less senior positions within the DOE will not make less than their current salary.)
