Position Summary


Responsible for the oversight of the Agency?s Human Resources Department. Responsible for the management and supervision of the activities of the RAIN Total Care Human Resources Unit, i.e., recruitment, selection and placement of staff and field employees including pre-employment screening of all administrative staff, home attendants and housekeepers background checks and clearances, DOH Criminal History Record Check (fingerprinting) where applicable, verification of license and education (where applicable), NY State Disability, Workers Compensation and UIB claims. Assume the role of the agency Employee Benefit Administrator.??Ensure Agency?is in compliance with?Federal and State regulations; HRA, DOH and vending sources regarding personnel matters

Essential Duties and Responsibilities


  • Annually reviews and makes recommendations to Management regarding the improvement and modification of the Agency's personnel policies, procedures, and practices.
  • Keeps abreast with homecare workforce management industry trends and employment legislation.
  • Ensure Agency's compliance with labor standards, NYS DOH and HRA mandates on recruitment, screening and retention of administrative staff and administrative personnel.
  • Responsible for Agency?s compliance with Federal and State legislation pertaining to all personnel matters.
  • Communicates changes in the Agency?s personnel policies and procedures and ensure the Agency?s proper compliance.
  • Assist executive management in the annual review, preparation and administration of Agency?s performance evaluation, progressive disciplinary procedures, wage and salary program and HR policies updates and modifications.
  • Ensure the Agency?s compliance in the maintenance and secure access to agency?s employees? records.
  • Conduct pre-employment orientation to prospective employees.
  • Conduct job interviews for administrative job vacancies.
  • Coordinates and/or conducts exit interviews to determine reasons behind separation.
  • Consults with legal counsel, as appropriate, and/or as directed by the Agency director on personnel matters.
  • Works directly with managers to assist them in carrying out their responsibilities on personnel matters.
  • Recommends, evaluates, and participates in the Agency?s Staff Development initiatives.
  • Develops and maintains a human resources system that meets Agency personnel information needs.

  • Liaise with union representatives with regards to employee grievances, union labor negotiations.
  • Interface with the NYS DOL on matters pertaining to UIB and WCB claims, Disability claims, NYS DOH complaint investigation, as well as, job recruitment activities.
  • Interface with the NYS DOH on matters pertaining to fingerprinting clearances, positive identification and resubmissions.
  • Assist in the preservation, implementation and management of the emergency response systems and procedures.
  • Develops and manages all recruitment endeavors, including but not limited to attending job fairs, development of a recruitment database, and Internet recruitment as well as posting internal job openings
  • Supervises the staff of the Human Resources Unit ensuring a smooth workflow and meeting work deadlines.
  • Communicates and handles client complaints in addition to interviewing home attendants involved in the client complaint process.
  • Interface with clients that have specific requests for home attendants to be hired.
  • Manages and enrolls the company staff in the benefit and pension program.
  • Assists in the selection and analysis of new cost-effective benefit programs for the agency.
  • Develops and implements policies related to all new HR relevant mandates from HRA and NYS DOH.
  • Participate on committees and special projects.
  • Other duties as assigned.

Essential Duties and Responsibilities

WCB/Disability Management and Administration

  • Provides required forms to all employees and assists in the completion and submission of WCB and Disability forms.
  • Follows up with on all WCB claims submitted to NYSIF and Workers Compensation Risk Management Organization
  • Prepare documentations for court appearances as needed.
  • Attends WCB hearings when requested.
  • Secures and verifies supporting documentations for Disability cases, i.e., medical certification extending disability period, medical clearance to support return to work.?
  • Ensures the accurate and timely submission and verification of Disability Claimants? medical clearances prior to their return to active employment with the program.


UIB Benefits Administration

  • Coordinates with Managers and Supervisors and Fiscal Unit in processing UIB documents, forms and correspondences related to all UIB claims.
  • Ensures the accurate completion and submission of UIB forms and other related correspondences.
  • Prepares all pertinent correspondences needed for unemployment hearings and other court appearances.
  • Attends all UIB hearings when required.
  • Gathers and reviews all information to dispute UIB claims.
  • Prepares correspondences to dispute erroneous UIB Claims.?
  • Maintains and ensures confidentiality of UIB records.


Other administrative functions:

  • Maintains NYSDOL mandated surveys, logs, etc.
  • NYS DOH Authorized Person ? ensure Agency?is in compliance with?regulations set forth regarding Criminal History Record Check Program (fingerprint submissions, clearances and positive identification) procedures.
  • NYS DOH Home Care Registry ? ensure all pre-employment Home Attendant Certificates are encoded into their database; encode all changes and upgrades of certificates as needed.
  • Maintain employee incident records for annual submission of OSHA Survey to the NY Bureau of Labor Statistics
  • Prepare quarterly report of employee accidents and incidents as well as time away from work to be presented at the Quality Assurance Meeting
  • Update and maintain Exclusions Database Portal (OIG, OMIG, SAM). To ensure agency?is in compliance with?screening of Field Staff, Office Staff, Vendors and Physicians as required my Medicaid Inspector General?
  • Ensure Licenses of Registered Nurse Licenses are up to date and verified accordingly.
  • Benefits Administration ? manage and ensure agency staff enrollments are submitted in a timely manner; submit coverage changes and termination; provide COBRA election forms as needed.
  • Liaise with Local Union 1199 Representatives with regards to employee grievances, disciplinary actions, suspension and terminations.
  • Notify Local Union?1199, and?HAS Fiscal Manager of all employee leave (s) (Disability, FMLA, Workers Compensation, and Personal Leave of Absences) asneeded to ensurecontinuance of benefits.??Notify Local Union 1199 and Fiscal Manager of all employee terminations of employment.
  • Coordinates and/or conducts exit interviews to determine reasons behind voluntary separation.
  • Consults with legal counsel, as appropriate, and/or as directed by the Executive Director on personnel matters.
  • Works closely with Manager and Supervisors to assist them in carrying out their respective responsibilities related to employee counseling, discipline, and termination.
  • Recommends, evaluates, and participates in the Agency?s Staff Development initiatives.
  • Develops and maintains a human resources system that meets Agency personnel information needs.
  • Develops and manages all recruitment endeavors, including but not limited to attending job fairs, development of a recruitment database, and Internet recruitment.
  • Knowledge of HR software, i.e. Paylocity.
  • Participate on committees and special projects.

Minimum Qualifications

  • ?Preferably BA with a concentration in Human Resources Management, Business Administration, Public Administration, or related field; or college units in related field with at least three years of full-time experience in public or private organizations in personnel management or supervision.
  • Good oral and written communication skills.
  • Good computer skills.
  • Ability to read, analyzes, and interprets reports, and legal documents. Ability to respond to common inquiries or complaints from clients, regulatory agencies, or members of the business community.
  • Bilingual in Spanish preferred.
  • Experience in a homecare work environment preferred
